What Nevada DUID Law Prohibits
Under NRS 484C.110, Nevada prohibits driving or being in actual physical control of a vehicle while under the influence of a controlled substance. Actual physical control generally means having the ability to operate a vehicle, even when it isn’t moving. The statute also addresses the combined influence of alcohol and a controlled substance, as well as the use of a chemical, poison, or organic solvent to a degree that makes someone incapable of driving safely.
Drug DUI allegations can involve illegal drugs, prescription medication, or over-the-counter medication. A charge may be based on alleged actual impairment, meaning the substance affected the person’s ability to drive safely. Other allegations involve a per se threshold, which is a legally specified concentration of a prohibited substance in blood or urine.
Drug Testing Thresholds & Marijuana Impairment
NRS 484C.110 identifies blood and urine thresholds for several substances, including amphetamine, cocaine and its metabolite, lysergic acid diethylamide, methamphetamine, phencyclidine, heroin, and heroin metabolites. Test results may therefore become central evidence in a DUID case. The measurements below use ng/mL, or nanograms per milliliter.
Examples of Nevada’s listed thresholds include:
- Amphetamine or methamphetamine: 100 ng/mL in blood or 500 ng/mL in urine.
- Cocaine or cocaine metabolite: 50 ng/mL in blood or 150 ng/mL in urine.
- Lysergic acid diethylamide or phencyclidine: 10 ng/mL in blood or 25 ng/mL in urine.
Marijuana is treated differently in important respects. Nevada’s per se marijuana threshold is 2 ng/mL of blood for delta-9-tetrahydrocannabinol and 5 ng/mL for marijuana metabolite. That numeric standard applies to felony violations under NRS 484C.400(1)(c).
For a standard first or second marijuana DUID charge, prosecutors must prove actual impairment rather than rely on the marijuana concentration alone. Lawful authorization to use marijuana or another controlled substance doesn’t, by itself, provide a defense to driving under the influence. Relevant questions include what was consumed, what officers observed, and whether the evidence supports the charged form of impairment.
Potential Consequences of a Sparks Drug DUI
Possible penalties depend on the charge and any prior qualifying offenses. Both criminal penalties and driver’s license consequences can affect decisions made during the case.
Nevada drug DUI consequences may include:
- First offense: Up to six months in jail, fines of up to $1,000, a 185-day license suspension, and 48 to 96 hours of community service.
- Second offense within seven years: Between 20 days and six months in jail, fines of up to $1,000, a one-year license suspension, and community service equivalent to the jail term, under a 2025 law change.
- Third offense: A felony carrying imprisonment in state prison and a fine from $2,000 to $5,000.
Sparks DUID cases commonly begin in Sparks Justice Court. Felony and gross-misdemeanor cases that don’t resolve in the lower court proceed in the Second Judicial District Court in Reno. The course of a case depends on the allegations, available proof, scheduled hearings, negotiations, and whether trial preparation becomes necessary.
